WAIVER  OF  LIABILITY  &  ASSUMPTION  OF  RISK


(for the October 3–12, 2025 Poland Wine Tour and all related activities)

Please read carefully. By paying a deposit or otherwise enrolling in this trip, you (the “Participant”) agree to the following terms with Philanthropic U, LLC, a Massachusetts‑registered organization, and its officers, employees, agents, contractors, and affiliated suppliers (collectively, “the Company”):

1.  Voluntary Participation & Eligibility

I am joining this tour of my own free will, am at least 21 years old, and possess all passports, visas, and health documentation required for travel.

2.  Acknowledgement of Inherent Risks

I understand that this itinerary involves, among other things:

  • international coach transfers, walking on cobblestones, uneven vineyard terrain, narrow staircases, and cellar environments;

  • scheduled tastings and consumption of alcoholic beverages;

  • variable weather, unfamiliar food, and differing safety standards;

  • potential exposure to illness, including COVID‑19 or other communicable diseases;

  • delays, strikes, political events, or acts of nature that may disrupt plans.

I acknowledge these and all other inherent risks—foreseen or unforeseen—associated with travel and wine‑tour activities.

3.  Assumption of Risk

I knowingly and freely accept all such risks, including the risk of personal injury, illness, property loss, or death, and assume full responsibility for my participation.

4 . Release & Hold‑Harmless Agreement

To the fullest extent permitted by Massachusetts law, I release, hold harmless, and covenant not to sue the Company, its Polish ground operator, and all owners, officers, employees, guides, and subcontractors from any and all liability, claims, damages, or expenses arising out of or related to my participation, whether caused by negligence or otherwise.

5.  Indemnification

I agree to indemnify and defend the Company against any claim (including attorneys’ fees) brought by a third party that I cause through my own conduct.

6.  Medical Fitness & Insurance

I certify that I am medically and physically able to participate and will carry adequate medical and trip‑cancellation insurance. I am fully responsible for any medical costs I may incur.

7.  Alcohol Responsibility

I will consume alcohol responsibly and comply with local laws. I understand that intoxication may result in my removal from an activity at my own expense.

8.  Itinerary Changes & Force Majeure

The Company may alter or cancel activities if necessary for safety or operational reasons. Refunds, if any, will follow the tour’s published Terms & Conditions.

9.  Photographic Release

I grant the Company permission to use photographs or video in which I may appear for legitimate promotional purposes without compensation.

10.  Governing Law & Severability

This Waiver is governed by the laws of the Commonwealth of Massachusetts. If any clause is held unenforceable, the remaining provisions remain in force.

BY SUBMITTING MY DEPOSIT I AFFIRM THAT I HAVE READ, UNDERSTOOD, AND ACCEPT THIS WAIVER IN ITS ENTIRETY.
